Accessing and using Splash & Dash Laundry service is on the condition of your acceptance of our Terms of Use.

Intellectual Property

The Service and its original content, features and functionality are and shall remain the exclusive property of Splash & Dash Laundry and its licensors.

Warranties

You warrant that you have the legal capacity to agree to the terms of this Agreement. You also warrant that your use of our website and app does not violate any applicable laws or regulations in your jurisdiction.

Additionally, you warrant that you are not prohibited from entering into this Agreement by an existing agreement. If you are accessing or using our website and app on behalf of an organization, you warrant that you are an authorized agent and have the authority to bind the organization to the terms of this Agreement.

Privacy Policy

Splash & Dash Laundry incorporates herein by reference its Privacy Policy, which is posted on our website.

Creating An Account

Eligibility and Acceptance of Terms:

To access the Services offered by Splash & Dash Laundry (“Splash & Dash”, “we”, “us”, or “our”), you must create an account (“Account”). By creating an Account, you represent and warrant that:

You are at least eighteen (18) years of age and have the legal capacity to enter into this Agreement.
You have read and understood this Agreement and agree to be bound by its terms and conditions.

You may not use the Services or create an Account if you do not agree to these Terms.

Account Types:

Splash & Dash offers Accounts for both individuals and businesses. Please choose the Account type that best suits your needs. You are solely responsible for ensuring that you choose the appropriate Account type. Sharing your login information with others is strictly prohibited to prevent unauthorized access and misuse of your Account.

Registration and Account Information:

When registering for an Account, you agree to provide accurate, complete, and up-to-date information. You are solely responsible for maintaining the accuracy of your Account information. You are also responsible for any activity that occurs through your Account, whether authorized or unauthorized.

Account Security:

You are solely responsible for safeguarding your username and password. You agree to keep your password confidential and not disclose it to any third party. You should choose a strong password and use best practices for password security. You agree to notify Splash & Dash immediately at CustomerSupport@SplashnDashLaundry.com of any unauthorized use of your Account or any other breach of security.

Communication:

By creating an Account, you consent to receive communications from Splash & Dash, including service-related emails, promotional offers, and important updates. You may manage your communication preferences by visiting your Account settings or contacting us. You acknowledge and agree that certain communications, such as service-related announcements and updates, may be sent to you even if you choose to opt out of receiving promotional emails.

Indemnification

Users agree to hold harmless, defend, and indemnify Splash & Dash Laundry from and against any and all claims, demands, judgments, liabilities, costs, and fees, including attorneys’ fees, arising from or relating to:

The creation or use of an Account.
The uploading or transmitting of User-generated Content.
A violation of any term or condition of this Agreement.
A violation of the rights of third parties, including privacy, publicity, or intellectual property rights.
A violation of any local, state, provincial, national, or international law, statute, regulation, ordinance, or treaty.

Splash & Dash Laundry reserves the right to control its defense, including, but not limited to, the choice to litigate or settle and the choice of counsel, in its sole discretion.

Limitation of Actions

You and Splash & Dash Laundry agree that any claim arising out of or relating to the website or mobile app must be commenced within one (1) year after the cause of action accrues. Failure to file such a claim within one year will permanently bar any and all relief.

Choice of Laws

This Agreement shall be governed in all respects by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions. You agree that any claim or dispute arising out of or relating to this Agreement shall be resolved by a court of competent jurisdiction located in Sacramento County, California. You agree to submit to the personal jurisdiction of the courts located within Sacramento County, California for the purpose of litigating all such claims or disputes.

Severability

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

Control of Operations

Splash & Dash Laundry reserves the right, in its sole discretion, to accept, reject, modify, suspend, or delete any User or User-generated Content, and to modify or discontinue the website and app or any of its associated services, at any time and without notice.

Splash & Dash Laundry: Third-Party App Disclaimer

As a third-party app provider, Splash & Dash Laundry is not responsible and cannot be held liable for any communication or conduct between users, whether through accounts or otherwise.

Limitations of Liability:

Mobile App: Splash & Dash Laundry makes no representations or warranties as to the quality or safety of the services offered through its mobile app, including, but not limited to, warranties of title or non-infringement.
Website: Splash & Dash Laundry makes no representations or warranties as to the quality or safety of the information or services offered through its website, including, but not limited to, warranties of accuracy, completeness, or timeliness.

Third Party Links

Our website and mobile app may contain links to third-party websites that are not owned or affiliated with Splash & Dash Laundry. We are not responsible for the content or practices of these third-party websites. We encourage you to review the terms of use and privacy policies of any third-party website before you provide any personal information or engage in any activity on their site.

Prohibited Uses

You are prohibited from using our website or mobile app (collectively, “Service”) to:

Sending unsolicited commercial emails.
Overloading the infrastructure or interfering with their operation.
Bypassing technological or security protections.
Using automated tools like bots or spiders for unauthorized access.
Attempting to access private data.
Posting content that collects personal information, is harassing, or violates intellectual property rights.
Posting or transmitting content that threatens harm or destruction of property through the website and/or App.
Posting or transmitting content that constitutes fraud, unwanted solicitation, a phishing scam, a pyramid scheme, or a chain letter.
Posting or transmitting any content that violates 18 U.S.C. § 2257.

Ordering & Payment

Splash & Dash Laundry is a pickup and delivery laundry service. You can place orders through our website or mobile app and pay with a credit or debit card. Your card will automatically be charged upon order completion, which includes laundry pickup, washing, drying, folding, and packaging.

Receipt Preferences

Tell us how you’d like to receive your receipt! By default, we’ll send it as a text message, but you can opt for email instead. Simply specify your preference when you create your account or during checkout.

By creating an account, you agree to the following terms and conditions:

Review Pricing & Fees: Before using our Service, please review our pricing and fees at https://splashndashlaundry.com/pricing.
Services and Products: Please note that all payments for laundry services, including additional items like clothes hangers, are non-refundable.
Authorization: By using our services, you authorize Splash & Dash Laundry’s payment processing agent to charge your card for agreed-upon services and products once your laundry is ready for delivery.
Chargebacks: Initiating a chargeback against Splash & Dash Laundry may incur additional fees charged by your credit card processor or financial institution. You are responsible for these fees.
Payment Obligations: You agree to pay all charges and fees associated with your order upon completion. Failure to do so may result in account suspension or termination. You are also responsible for any collection costs, including legal fees, incurred by Splash & Dash Laundry.
Unpaid Orders: If your payment fails, we will temporarily restrict your ability to place new orders until your payment information is updated and your outstanding balance is settled. During this time, you will receive reminders via text and/or email to update your payment information. If payment remains outstanding for 90 days after your laundry service is complete, we reserve the right to donate your laundry to charitable organizations or individuals in need.

Disputes

If you have any concerns about the amount or validity of a payment made under this Agreement, you must notify Splash & Dash Laundry in writing within ten (10) days of the transaction date. Failure to notify us within this timeframe will waive your right to dispute the payment.

Remember, it’s important to provide details about your dispute in your written notice, including:

Your name and contact information
Order number or transaction reference
Date of the transaction
Amount disputed
Reason for the dispute

We will review your dispute promptly and contact you within 48 hours via email to discuss the issue and possible resolutions.

Please note: dispute notifications must be submitted in writing for proper documentation and investigation.

Allergy Notice

Splash & Dash Laundry uses shared washing machines to process laundry. Different detergents are used in these machines, and it’s possible that small amounts of previous detergents, which may not be hypoallergenic or could trigger allergies, may remain after rinsing.

By using Splash & Dash Laundry services, you acknowledge and accept this potential risk and assume full responsibility for any resulting injury or allergic reaction.

Damaged Items

While we prioritize garment care, there’s an inherent risk of color loss, bleeding, or shrinkage during the cleaning process. We handle your clothes with utmost care, but these situations can occasionally occur.

To facilitate investigation and resolution, all damaged items must be reported within three (3) days of delivery. Unfortunately, claims submitted later may not be considered and is up to our discretion.

Please note that Splash & Dash Laundry is not responsible for damage caused by loose items like lipstick, pens, or lighters.

If your item is deemed damaged by Splash & Dash Laundry, we offer two reimbursement options:

Account credit: Receive up to three (3) times the per-pound cleaning cost of the damaged item credited to your account. This applies regardless of brand, price, or condition of the garment(s).
Account refund: Receive up to two (2) times the per-pound cleaning cost of the damaged item refunded to your account. This also applies regardless of brand, price, or condition of the garment(s).

Lost Items

While garments entrusted to Splash & Dash Laundry are treated with care, an inherent risk of loss always exists during the cleaning process. We take proactive measures to prevent such situations, but cannot guarantee against them entirely.

To allow for thorough investigation and resolution, any lost item must be reported within three (3) days of delivery. Unfortunately, claims submitted later may not be considered and is up to our discretion.

Please note that Splash & Dash Laundry is not responsible for loose items lost during the cleaning process, such as; watches, jewelry, Airpods, or cufflinks.

If your item is deemed lost by Splash & Dash Laundry, we offer two reimbursement options:

Account credit: Receive up to three (3) times the per-pound cleaning cost of the lost item credited to your account. This applies regardless of brand, price, or condition of the garment(s).
Account refund: Receive up to two (2) times the per-pound cleaning cost of the lost item refunded to your account. This also applies regardless of brand, price, or condition of the garment(s).

Laundry Pickup & Delivery

Splash & Dash Laundry offers the convenience of choosing a pickup and drop-off location that works for you when you’re not at home. Here are some popular options:

Front door: Ensure there’s a sheltered area like a porch or awning to protect your laundry from the elements.
Porch: Choose a well-lit and easily accessible area for the driver.
Carport: Only if accessible from the outside and secure.
Clean covered receptacle: If using a bin or container, ensure it’s large enough for your laundry bag(s) and has a secure lid.
Apartment building lobby (with security personnel): Only if permitted by the building management and accessible to the driver.

Important Reminders

Driver Access: Our drivers cannot enter private spaces like residences, cars, or garages. Please choose a publicly accessible location.
Delivery Confirmation: After completing your delivery, the driver will take a picture of your laundry items at the designated location and send it to you via text message for confirmation.
Delivery Responsibility: While we take all reasonable precautions, Splash & Dash Laundry cannot be held responsible for any loss or damage to your items once delivered at the designated location.

Termination

We reserve the right to terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including, but not limited to, a breach of these Terms.

Upon termination, all provisions of these Terms that are intended to survive termination will remain in effect, including, but not limited to, ownership provisions, warranty disclaimers, indemnification clauses, and limitations of liability.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
